Website Terms and Conditions
Effective from:
Please read these Website Terms and Conditions carefully before accessing our website, creating an account, purchasing a product or service, or participating in any of our programs.
These Terms explain the rights and responsibilities that apply when you interact with Robert Reeves Pty Ltd. They include important provisions concerning course access, payments, refunds, intellectual property, health and spiritual information, limitations of liability and dispute resolution.
By accessing or using our website and services, you agree to these Terms to the extent that they lawfully apply. When purchasing a product or service, you may also be required to expressly accept these Terms and any additional conditions relevant to that purchase.
If you do not agree with these Terms, please do not use our services or make a purchase.
1. About us and this agreement
These Terms are issued by Robert Reeves Pty Ltd, ABN 91 161 316 507, referred to as we, us or our. References to Robert personally mean the individual Robert Reeves, rather than the company.
They apply to our websites, the Academy of Spiritual Development, associated digital learning environments and services that expressly refer to them. The Academy is our learning environment, not a separate contracting entity.
Our offerings may include courses, certifications, meditations, downloads, memberships, communities, events, readings, naturopathic consultations, publications, physical products and complimentary resources. Availability and inclusions depend on the offer.
For a purchase, the agreement comprises these Terms, the applicable offer information and any additional conditions disclosed and agreed before purchase. Specific conditions prevail over general conditions to the extent of a lawful inconsistency. Additional booking or promotion rules apply where identified.
We make these Terms available before purchase and may require express acceptance. Public website use is subject to the relevant conditions to the extent they are lawfully incorporated. Our Privacy Policy and Cookie Policy explain information-handling practices; accepting these Terms does not itself establish optional marketing consent.
Earlier purchases retain the contractual rights agreed at purchase, together with any lawful later agreement. These Terms do not retrospectively reduce existing entitlements.
You are responsible for laws applicable to your own activities. We remain responsible for the legal obligations that apply to our supply.
2. Accounts, eligibility and acceptable use
Public pages may be browsed for lawful informational purposes. Purchases and contractual enrolments are intended for adults aged 18 or over with legal capacity. A parent or guardian proposing an enrolment for a minor must contact us first. Approval and suitable participation requirements depend on the program.
Provide accurate registration and purchase details and keep them reasonably current. We may request proportionate identity or purchase verification for security, fraud prevention or account recovery.
Each learning account is for one authorised individual unless we agree otherwise. Do not share credentials or give family, colleagues or clients access to paid materials. Gifts must identify the intended recipient; the recipient's learning licence is personal, while the purchaser remains responsible for authorised payments. Group licences require written agreement.
Protect your credentials and devices and notify us promptly of suspected compromise. You are responsible for activity you authorise. We may require password resets or temporarily restrict access to investigate genuine security concerns.
You must not:
- Access others' accounts or bypass passwords, paywalls or access controls.
- Introduce malware, disrupt systems or conduct unauthorised security testing.
- Harvest personal information or systematically extract restricted content using automated or manual means.
- Impersonate others, commit fraud or infringe legal rights.
- Harass, threaten, unlawfully discriminate or knowingly publish unlawful false statements of fact.
- Use our services for unauthorised solicitation or commercial distribution.
These rules do not prohibit genuine reviews, lawful criticism, regulatory complaints, permitted accessibility uses or authorised search-engine indexing of public pages. Suspension and termination are governed by section 20.
3. Orders, prices and payments
Review the offer before purchasing. Access, content, bonuses, support, delivery dates and any time limits are those described in the offer. Personal assistance, future updates, live sessions and additional products are included only where promised.
Prices are in the currency identified. We will disclose applicable taxes and mandatory charges as required before purchase. Your bank or payment provider may charge its own conversion or international transaction fees.
Submitting payment confirms that you are authorised to use the payment method and authorise the disclosed charges. Independent providers may process transactions. Maintain accurate billing details and promptly report suspected errors or fraud.
We may hold or refuse an order on reasonable grounds such as suspected fraud, legal restrictions, unavailability or a material pricing error. If an error affects an existing order, we will explain the issue and seek an appropriate resolution. We will not impose an undisclosed price increase on an accepted purchase. If we cancel an order without supplying it, we will refund amounts collected for it and provide any further required remedy.
Discounts, codes and bonuses have the disclosed promotional conditions. Unless stated otherwise, they cannot be combined or retrospectively applied. We may prevent fraudulent code use.
Where we receive commissions, referral fees or other benefits from recommendations, we will disclose relevant commercial relationships where required. Third-party purchases have their own supplier conditions.
4. Payment plans and payment disputes
A fixed-price instalment plan is a commitment to pay the total price on the disclosed schedule, unless expressly sold as a cancellable subscription. Ceasing to study or use materials does not itself cancel remaining instalments.
You authorise scheduled payments. If one fails, we may request updated details and give reasonable notice and an opportunity to resolve the arrears before suspending affected access, unless urgent action is justified. We may lawfully recover amounts due, but will not impose undisclosed penalties or automatic collection charges.
An outstanding payment must be assessed against any valid cancellation, refund or statutory remedy. A full refund cancelling the purchase also cancels its remaining instalments. Partial remedies will address the appropriate balance. Receiving a certificate does not discharge an otherwise valid payment obligation.
Please contact us if a charge concerns you. This is an invitation to resolve it, not a requirement to contact us before exercising bank, payment-provider or statutory rights.
If a payment is reversed or withheld during a genuine dispute, we may proportionately suspend access to the related unpaid product while investigating, with notice where practicable. A dispute does not automatically establish misconduct or justify removing unrelated purchases. We will review restrictions when the outcome is known and restore access where appropriate.
We may provide relevant purchase, acceptance, delivery and access records to the payment provider in accordance with privacy law. Neither party is entitled to duplicate recovery for the same refunded or reversed payment.
5. Memberships and subscriptions
This section applies only to products expressly sold as recurring memberships or subscriptions. The offer will disclose price, billing frequency, included benefits, any minimum commitment, trial, introductory rate and renewal conditions.
You authorise the disclosed recurring charges until cancellation or expiry. Any conversion from a free trial or discounted period to paid or higher-priced billing must be explained before subscription.
Membership benefits are those described in the offer. A changing library or community does not confer Lifetime Access unless expressly promised. We may make reasonable operational and content updates while respecting material commitments.
Cancel through the method disclosed at signup or email [email protected]. We will provide an accessible cancellation process. Unless a lawful minimum commitment was clearly agreed, a valid cancellation request received before renewal stops that renewal, even if our confirmation follows later. Access ordinarily continues to the end of the paid period. Previous periods are not automatically refundable merely because you cancel.
Existing subscribers will receive advance notice of proposed price increases or materially adverse changes, with sufficient opportunity to cancel before they take effect. Increases will not retrospectively alter a paid period or override an agreed protected price. We will obtain further agreement where required.
If we discontinue a membership or remove a material prepaid entitlement, we will give reasonable notice where possible and provide any required cancellation, refund or other remedy for undelivered benefits. Cancelling a membership does not remove separately purchased course entitlements.
6. Digital products and delivery
Digital purchases grant the specified licence and access, not ownership of copyright. Delivery may occur through the Academy, an associated app, streaming, email, downloads or another identified method. Access duration, release schedules and any expiry will be disclosed with the offer; Lifetime Access is addressed separately below.
You need compatible equipment, supported software and an internet connection. Material technical requirements will be identified where relevant. We are not responsible for problems caused solely by your equipment or connection where we have met our obligations.
If delivery or access fails, contact [email protected] with identifying order details. We will reasonably investigate and address problems within our control. An access problem does not remove applicable consumer remedies.
Streaming access does not authorise downloading or recording. Where downloads are included, you may retain authorised copies within the licence. Ordinary browser caching, permitted personal study notes and uses allowed by law are not prohibited. Downloaded files must not be shared or redistributed.
We may change delivery technology or providers and will take reasonable steps to preserve paid entitlements. A routine migration does not end contractual course access. We may require proportionate account verification or updated login arrangements and will provide relevant instructions.
Third-party apps or marketplaces may administer purchases, billing and cancellation through their own processes. We will identify relevant arrangements where applicable. Their involvement does not remove responsibilities we retain as supplier.
7. Lifetime Access
Meaning and scope
Where expressly sold with Lifetime Access, a course provides access for its commercial lifetime, subject to the commitments and discontinuation provisions in this section. This is not the natural lifetime of the student, Robert or another individual, and does not require the business to operate indefinitely.
Access does not expire automatically after a fixed number of years. Closing enrolments, withdrawing public advertising or retiring the course from sale does not, by itself, end access for existing eligible students.
Lifetime Access covers the core materials included at purchase, such as recorded lessons, meditations, written resources and worksheets. Replacements or revisions forming part of the continuing core course remain accessible within that entitlement. It does not automatically include separately sold courses, future certifications, consultations, coaching, memberships, additional live events or expressly time-limited bonuses. Specific promises made at purchase remain binding.
Changes and discontinuation
We may correct, reorganise or replace materials for clarity, technical compatibility, currency, legal compliance or safety, without improperly reducing the substance of the purchased entitlement. We need not create new content or preserve every historical version unless promised.
Permanent discontinuation for existing students must have a substantive, good-faith basis, taking account of the original commitment and reasonably practicable alternatives. Grounds may include:
- Permanent business closure or insolvency preventing continued supply.
- Robert's serious illness, incapacity or death where continued operation cannot reasonably be arranged.
- Legal, safety or intellectual property restrictions preventing continued provision.
- Loss of essential services where reasonable replacement arrangements cannot be maintained.
- Other material circumstances making continued course operation genuinely impracticable or commercially unsustainable after reasonable alternatives have been considered.
An ordinary platform change or closure of new enrolments is not sufficient by itself. This section does not permit arbitrary withdrawal merely because a newer product is preferred.
Where reasonably practicable, we will give advance notice and take reasonable steps to offer suitable alternatives, considering technical feasibility, third-party rights and the purchased materials. These may include a replacement platform, a transition period, equivalent resources or authorised downloads. We do not guarantee every stream or resource can be downloaded. Alternatives do not displace a refund or other remedy to which you are legally entitled.
Access is personal to the authorised student and subject to the licence and proportionate misuse provisions. Earlier purchases retain their original rights; this definition does not retrospectively impose a shorter entitlement.
8. Intellectual property and course licences
Our original content and branding belong to the company, Robert personally or the relevant rights holder and are used with authority. Protected material may include lessons, curricula, recordings, meditation scripts, manuals, transcripts, exercises, assessments, certificates, artwork, music, software and original compilations. Rights not expressly granted are reserved.
Your licence is limited, non-exclusive, personal, non-transferable and non-sublicensable unless a different licence is expressly provided. It permits authorised learning and use, including the professional application described below where applicable.
Except with written permission, an express licence or permission under law, do not:
- Copy, record, transcribe, translate or systematically extract protected materials for unauthorised use.
- Upload, publish, distribute, broadcast, resell, sublicense or provide them to others.
- Repackage or substantially reproduce our content as your own work or as substitute educational products.
- Remove copyright notices, watermarks or identifying marks.
- Use our branding or certificates to imply unauthorised affiliation or endorsement.
You may create your own private study notes and use authorised resources within their licence. These permissions do not authorise distributing substantial protected content.
For certification programs and other training expressly intended for professional application, students may apply learned techniques in their own individual or group client sessions within the program's scope and their lawful competence. Explaining a process to a client as reasonably necessary for that session does not itself constitute practitioner training.
This permission does not authorise teaching our named programs or distinctive course-specific methods as training for others, training practitioners or instructors, issuing our certificates, or reproducing our curriculum. These activities require express written permission. It also does not automatically authorise playing our recordings, distributing our materials or reproducing our scripts in commercial sessions or products.
These restrictions protect agreed licence boundaries, protected expression and legitimate proprietary interests. They do not claim exclusive ownership of general spiritual ideas, public knowledge, independently developed expression or techniques that cannot lawfully be exclusively controlled.
Do not use protected materials for unauthorised AI training, datasets, automated extraction, competing products or services that reproduce our protected content. This includes substantial uploads for those purposes and bypassing access controls. Independently written personal notes and conduct that cannot lawfully be restricted remain permitted.
9. Certification and independent professional practice
Certification is available only where the program offers it. Certificates are issued automatically when the student meets the published completion requirements, including completing the required quiz and achieving any stated passing score. Do not falsify completion or obtain a certificate through another person's work or account.
A certificate records completion of our program requirements. Unless expressly stated and independently verified, it is not a government qualification, statutory licence, professional registration, external accreditation or guarantee of competence for every activity. Automatic issue does not represent individual supervision or assessment of every aspect of a graduate's practice.
Graduates may accurately describe their completion and use designations expressly permitted by the program. They must not alter certificates, issue them in our name or misrepresent accreditation, authorisation or affiliation. We may investigate and correct certificates issued through fraud or material error, giving a reasonable opportunity to respond where appropriate.
If a certification purchase is fully refunded and the enrolment cancelled, permission to use its associated certification designation ends, subject to applicable law and existing contractual rights. We may record the certificate as withdrawn, and it must not be presented as current. This does not erase the factual record of study undertaken.
Students and graduates practising independently are responsible for their own services, decisions, representations, client consent, privacy, competence, insurance and legal compliance. No course authorises diagnosis, prescribing or regulated healthcare outside the person's lawful qualifications.
Completion creates no employment, agency, partnership, franchise or supervisory relationship. We do not control, insure or guarantee independent practitioners' services or authorise therapeutic claims on our behalf. We are not responsible merely because they studied with us; this does not exclude responsibility for our own legally actionable conduct.
If submitting client examples, obtain necessary consent, minimise personal information and de-identify submissions unless identifiable information is specifically requested through an appropriate consent process.
10. Communities and user contributions
Participate respectfully. Do not post unlawful, threatening, discriminatory, defamatory, infringing or deliberately abusive material; spam or solicit members without permission; expose another person's private information; or promote dangerous health advice as a substitute for professional care.
Do not take or share unauthorised screenshots, recordings or copies of private community discussions. This does not prevent lawful complaints, reporting safety concerns or disclosures required or protected by law. Other participants may see your posts; we cannot guarantee that every participant will maintain confidentiality.
You retain ownership of your original contributions and confirm that you have permission to share them. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, transmit and technically adapt them as reasonably needed to operate, secure and moderate the service, including necessary provider functions and backups.
This is not unrestricted advertising permission. Following deletion or account closure, we may retain material reasonably needed for legal records, security, backups or discussion continuity, subject to privacy obligations. It does not authorise unrelated new promotional use.
We may proportionately remove content or restrict participation to address breaches, complaints, safety or legal requirements. We need not approve every post beforehand and cannot guarantee immediate detection of all inappropriate material.
Participants' opinions and experiences are their own, not necessarily ours or individual professional advice. Genuine reviews, fair criticism and lawful complaints remain permitted.
11. Testimonials, feedback and submissions
Testimonials describe individual experiences, not guaranteed outcomes. We will not knowingly fabricate them or materially misrepresent genuine feedback. Reasonable editing for length or clarity must preserve meaning.
We will obtain appropriate permission before publishing identifiable feedback from private communications. Public testimonial submissions may be used within the clearly explained submission permissions. Images, sensitive information and identifiable health experiences require appropriate handling and any necessary additional consent. Operational community permissions do not automatically authorise advertising use.
We welcome ordinary feedback but do not invite unsolicited confidential proposals, course concepts, manuscripts or creative works without prior agreement. Sending an idea does not itself create confidentiality, a partnership or an obligation to pay for independently developed or legitimately obtained similar material. It does not transfer your ownership or authorise unlawful copying or misuse of confidential information.
12. Educational, health and spiritual information
General education and individual care
Except for an expressly agreed individual professional service, our courses, meditations, articles, newsletters and other content provide general education, spiritual development or wellbeing information. They are not individually tailored to your health history, medication, circumstances or treatment needs.
Accessing general content or joining a group spiritual activity does not, by itself, establish an individual naturopathic consultation, assessment or treatment plan. Any expressly agreed individual professional service remains governed by its actual scope and applicable duties.
Spiritual and energy healing
Our spiritual work may include prayer, angels, intuitive development, energy healing, protection, manifestation and oracle guidance. These involve personal belief, interpretation and experience.
Spiritual and energy healing activities are offered as complementary wellbeing experiences, rather than medical diagnosis or treatment. They do not replace appropriate professional healthcare. We do not promise particular perceptions, messages, future events or spiritual outcomes, or that general spiritual practices prevent, diagnose, treat or cure disease.
Health and natural therapies
We may discuss naturopathy, nutrition, herbs, supplements, traditional practices, emotional wellbeing and energy-based approaches. General discussion is not a personalised diagnosis, prescription or treatment plan, or assurance that a remedy is suitable, safe or effective for everyone.
Consult an appropriately qualified healthcare professional about symptoms, medical conditions, medications and treatment changes. Do not delay necessary care or stop or change prescribed medication or treatment in reliance on general content or participation in spiritual activities. Pregnancy, breastfeeding, medication use and existing conditions may require particular guidance.
Mental and emotional wellbeing
Meditation, visualisation, breathwork and emotional reflection may produce discomfort, strong emotions or distress. They do not replace psychological or psychiatric care. Seek suitable professional guidance where mental health concerns, trauma symptoms or other circumstances may affect participation. You may pause, adapt or skip an optional exercise.
Our website, email, community and educational events are not emergency or crisis-response services. Do not use them to seek urgent assistance. If there is immediate danger or a medical or mental health emergency, contact local emergency services or attend an emergency department.
Safe participation
Use a safe, suitable environment for online sessions and guided practices. Do not meditate, deeply relax or undertake attention-altering exercises while driving, operating machinery or doing tasks requiring continuous attention. If an exercise causes discomfort or distress, or you feel unwell, stop and seek appropriate assistance where needed.
Personal decisions and outcomes
Information about abundance, income, business or manifestation is general educational or spiritual material, not personalised financial, investment, tax, accounting or legal advice. Obtain qualified advice for significant decisions.
Experiences and results vary. No financial, professional, physical, emotional or personal outcome is promised unless a specific lawful commitment is expressly made. Examples and testimonials do not guarantee your results. You remain responsible for independent decisions, without removing duties we owe by law.
13. Individual consultations and readings
An expressly booked naturopathic consultation is distinct from general educational content. Its scope, duration, fees, delivery method, cancellation conditions and professional arrangements will be explained before booking.
Provide relevant, accurate health history, medication details and updates reasonably needed for care. Recommendations depend on available information and the practitioner's lawful scope. Referral or cooperation with other healthcare professionals may be appropriate. Consultations do not replace emergency care or guarantee outcomes.
Client intake, informed consent and treatment documents apply where provided, alongside privacy and professional recordkeeping obligations. We remain responsible for meeting our own professional duties.
Personal spiritual readings have the delivery timeframe, format and booking conditions stated in their offer. They do not guarantee future events and are not substitutes for medical, psychological, legal or financial advice.
Any rescheduling period, missed-appointment charge or cancellation fee must be disclosed before booking and be lawful. Individual consultations, readings and customised services are outside the general digital-product satisfaction guarantee unless expressly included. Statutory remedies remain available.
14. Live events and recordings
The offer identifies dates, time zone, format, duration and inclusions. Replays, downloads and personal support are included only where stated. Follow reasonable participation and safety instructions.
We may make reasonable operational changes. If we cancel or materially alter an event, we will notify affected customers where practicable and provide the remedy required by the agreement or law. A customer need not accept a materially different replacement where entitled to cancel or obtain a refund.
Live events have the change-of-mind conditions disclosed before purchase and are not automatically covered by the digital-product satisfaction guarantee.
Before recording identifiable participation, we will explain what is captured, the intended audience and uses, and relevant choices or consent requirements. Uses may differ between an attendee replay and an ongoing educational product. Appropriate permission will be obtained where required. Unrelated promotional use requires the relevant separate permission.
Participants must not make unauthorised recordings or distribute event material, private discussions or attendees' personal information. Lawful accessibility arrangements and disclosures protected by law remain unaffected.
15. Refunds and consumer rights
Voluntary 30-day satisfaction guarantee
Unless a different arrangement is clearly disclosed before purchase, qualifying one-off purchases directly from us of prerecorded digital courses, certification courses, meditation products and similar self-paced educational products include a 30-day money-back satisfaction guarantee.
If dissatisfied, request a refund in writing within 30 calendar days of purchase. For a preorder, the period starts when the purchased product first becomes available. You need not prove a defect or refrain from accessing the content. A timely eligible request remains valid if processed later.
Email [email protected] with the purchase name, email address and enough information to identify the transaction. We may reasonably verify the transaction and prevent duplicate or fraudulent claims, without imposing unnecessary barriers. Eligible refunds will be processed without unnecessary delay, normally to the original payment method where available. Bank and provider processing times vary.
Unless expressly included, this voluntary guarantee does not cover live events, memberships, recurring subscriptions, physical goods, readings, appointments or customised services. Mixed live and prerecorded offers must explain their refund arrangement before purchase. A different voluntary policy cannot remove statutory rights.
A voluntary bundle refund ordinarily covers the purchased bundle, not selected components. Associated bonuses may also end. This does not prevent a partial remedy required by law.
Following a refund cancelling the purchase, access and the associated licence end. Stop using the refunded materials and delete usable downloaded copies unless law permits retention. Copies retained solely for required records must not be used or distributed. Certification permissions are addressed in section 9.
We may investigate genuine fraud or deliberate misuse, but accessing or completing an eligible product does not itself defeat this guarantee. Remaining instalments are addressed under section 4.
Statutory rights
Our goods and services are subject to applicable Australian Consumer Law guarantees and other mandatory protections. These may entitle you to repair, replacement, repeat performance, cancellation, refund, price reduction or compensation, depending on the failure and applicable law.
These rights are additional to voluntary policies and do not automatically end after 30 days. Nothing in these Terms excludes, restricts or modifies a right, guarantee, duty or liability that cannot lawfully be excluded, restricted or modified. This applies throughout the document, including access, payment, disclaimers, termination and liability provisions.
International customers retain mandatory protections that lawfully apply to their transaction, including any applicable withdrawal rights. Where specific information, consent or processes are required, we will provide them. Third-party purchase processes do not remove rights against a legally responsible supplier.
16. Physical products
Physical products have the descriptions, availability, shipping costs, destinations, estimated delivery arrangements and restrictions disclosed before purchase. Delivery estimates are not guaranteed unless expressly stated. We will address non-delivery, delays, damage and incorrect items in accordance with our obligations.
Provide accurate delivery information and promptly report changes. Reasonable additional costs caused by an incorrect address may apply where disclosed and legally permitted. Destination-country customs duties or import taxes may be payable by recipients where applicable and properly disclosed.
Follow product-specific directions, precautions and storage instructions. Consider relevant ingredients, sensitivities and intended uses. Product warnings supplement rather than replace our safety obligations, and this clause does not excuse an unsafe or misdescribed product.
Any voluntary change-of-mind returns policy will be stated with the offer. Faulty or non-compliant goods retain statutory remedies; the digital-product satisfaction guarantee does not automatically govern physical products.
17. Promotions, surveys and evaluation
Competitions, giveaways and prize draws have specific published rules covering relevant eligibility, locations, dates, entry methods, prizes, selection, notification and fulfilment. Chance-based promotions must comply with applicable authorisations and laws. Required social-platform disclosures will be included.
We may disqualify fraudulent, automated, unlawful or otherwise ineligible entries under the published rules. We will not arbitrarily withdraw an awarded prize or materially change a promotion contrary to law.
Entering a promotion or requesting a free resource does not itself establish consent to unrelated marketing. Any newsletter or marketing signup must be clearly explained and supported by the required consent process.
We may invite optional surveys, feedback or evaluation and use lawful operational data and appropriately aggregated or de-identified findings to improve services. Identifiable research or sensitive information requires an appropriate lawful basis and additional consent where necessary. Optional participation is voluntary; a disclosed course quiz or assessment is a separate educational requirement.
18. Third-party services and technology
We use providers for hosting, payments, learning platforms, streaming, email and related functions, and may link to independent websites or resources. Third parties have their own conditions and privacy practices. Links do not automatically constitute endorsement.
We take reasonable steps to support security, accurate information and reliable delivery, but cannot guarantee uninterrupted operation, compatibility with every device, continuously current general information or complete freedom from malware and technical faults.
Maintain reasonable device security, software updates and backups and use authorised download sources. We are not responsible for loss caused solely by compromised user equipment, unauthorised sources or independent third-party conduct where we have fulfilled our obligations.
We will reasonably investigate material faults within our control and address affected purchases under our contractual and statutory duties. Using an external provider does not remove responsibilities we retain for our products, services, privacy or security.
19. Liability, indemnity and enforcement
Liability
This section is subject to the overriding protection of non-excludable rights in section 15. It does not remove liability for our fraud, wilful misconduct or any negligence, personal injury, breach or other matter to the extent liability cannot lawfully be excluded or limited.
To the extent legally permitted, we exclude liability for indirect, special or consequential loss, including lost profits, opportunities, goodwill or data to the extent those losses are indirect or consequential. This does not exclude reasonably foreseeable loss or compensation recoverable under mandatory consumer law.
We are not responsible for independent personal decisions or practitioners' services merely because they relate to our general teaching, nor for loss caused solely by matters outside our reasonable control where we met our obligations.
For services not ordinarily acquired for personal, domestic or household use, where section 64A of the Australian Consumer Law permits it and reliance is fair and reasonable, liability for failure to comply with an applicable consumer guarantee is limited, at our reasonable election, to supplying the services again or paying the cost of resupply. This limitation does not apply where legally unavailable, reduce our voluntary satisfaction guarantee or impose a general monetary cap on consumer remedies.
Where lawful, these exclusions and limitations also benefit Robert and our officers, employees and authorised representatives for work performed on our behalf. They do not remove anyone's liability where it cannot lawfully be excluded or limited.
Indemnity
To the extent permitted by law, you indemnify the company and its relevant officers, employees and authorised representatives against reasonable third-party losses and legal expenses to the extent caused by your unlawful conduct, infringement, fraudulent or seriously unauthorised use, unauthorised commercial exploitation, or material breach of these Terms for which you are legally responsible.
The indemnity excludes loss caused by our negligence, wrongdoing, breach or legal non-compliance. We will give reasonable notice of claims, mitigate loss and allow reasonable participation in their defence. We will not impose unreasonable expenses or settle a claim creating obligations for you without appropriate agreement.
Enforcement
We may seek lawful remedies for infringement or serious misuse, including removal, damages, an account of profits or injunctions. A court determines the availability of relief; these Terms do not guarantee an injunction or predetermined damages. Report suspected infringement to [email protected] with identifying details and the basis of the concern.
20. Suspension, termination and account closure
We may proportionately restrict or terminate affected access for serious or repeated breaches, piracy, fraudulent access, material payment misconduct, harassment, safety or security risks, or legal requirements.
Where appropriate, we will warn you, explain the concern and provide an opportunity to correct it. Immediate action may be necessary to protect people, systems, intellectual property or legal compliance. Temporary restrictions will be reviewed within a reasonable period, and access restored where the concern is resolved.
Action should relate to the affected service and seriousness of the issue. Removing community participation does not automatically cancel unrelated purchased courses. We will address prepaid, undelivered entitlements and required remedies. Termination is not an automatic right to retain every prepaid amount or accelerate every future payment.
Valid termination may end the affected licence. Accrued lawful payment obligations and provisions intended to survive remain enforceable. Course discontinuation is separately addressed in section 7.
You may request account closure or cancellation through the applicable process. We will clarify and address linked subscriptions so closure does not inadvertently leave recurring billing active. Closure does not itself cancel a fixed-price payment-plan debt or create a change-of-mind refund. Personal-information deletion requests remain subject to privacy and recordkeeping requirements.
21. Privacy and communications
Our Privacy Policy and, where applicable, Cookie Policy explain personal-information collection, use, disclosure and storage. Health and sensitive information will be handled under applicable privacy and professional obligations. These Terms are not blanket consent to publish private information or use it for unrelated marketing.
We may send necessary operational communications such as receipts, access instructions, payment notices, security alerts and material service updates using your supplied contact details. Keep those details current. Electronic contractual notices may be used where lawful; any legally prescribed service requirements prevail.
Marketing requires an appropriate lawful basis, including consent where required, and must identify the sender and provide an appropriate unsubscribe method. You may unsubscribe without losing purchased course access. Necessary transactional messages may continue after marketing unsubscribe.
22. Changes, disputes and general provisions
We may update these Terms for changes in services, technology, operations or law. The published version will identify its effective date. Changes to future website use apply from that date where lawfully incorporated. Material changes to existing paid rights require the notice, agreement and remedies required by the contract and law; publication alone does not retrospectively remove promised entitlements.
For complaints, email [email protected] with the issue, identifying details and desired resolution. We will reasonably review concerns and seek constructive resolution. The parties may agree to independent mediation and its costs. A mediator facilitates agreement rather than imposing a decision; an agreed settlement may become binding. Informal resolution does not prevent urgent relief, regulatory complaints, tribunal access or statutory remedies.
New South Wales law governs, subject to applicable mandatory laws. NSW courts and tribunals have non-exclusive jurisdiction. This does not remove mandatory overseas protections or a right to bring proceedings elsewhere where applicable law provides it.
The agreement described in section 1 is the entire agreement for the relevant transaction, without excluding legally protected representations or remedies. Headings aid navigation. Legislative references include amendments and replacements. An invalid provision may be severed where lawful without automatically invalidating the rest. Failure or delay in enforcement is not automatically waiver.
We may arrange lawful business succession or transfer as part of a genuine sale or restructure, preserving customer entitlements and complying with consent, privacy and other requirements. Transfer does not itself release obligations where the law or agreement requires otherwise. Personal licences and accounts cannot be transferred without permission, except as required by law.
Extraordinary events beyond reasonable control may excuse affected delay or non-performance to the extent lawful, provided reasonable steps are taken to minimise disruption. They do not automatically remove refund or consumer rights. Accrued payments, intellectual property, applicable confidentiality, liability, indemnity and dispute provisions survive termination where appropriate and enforceable.
